NOTICE OF PENDING JUDGMENT, STATUS OF CLASS ACTION AND NOTICE OF HEARING
To: all persons who rented residential mobile home lots from Heritage Property Group, LLC (“Heritage), at 6074 Deerfield Road, Milford, Ohio, 45150-2224, from October 1, 2010, to August 11, 2011. These premises are commonly known as Green Acres Mobile Home Park.
READ THIS NOTICE CAREFULLY BECAUSE IT MAY AFFECT YOUR RIGHTS WITH RESPECT TO ANY POTENTIAL PROCEEDS AND ANY POTENTIAL JUDGMENT.
This notice informs you about a proposed settlement between plaintiffs and the Green Acres Mobile Home Park operator, Heritage Property Group, LLC, concerning alleged violations by Heritage of their rental agreements with you and alleged violations of ORC 3733.01, et seq., which is the Ohio law governing mobile home park operations. This Notice also contains information regarding the status of the case and your options regarding this case.
CASE SUMMARY
On August 11, 2011, attorneys Lou Blessing, Brian Perkins and Susannah Meyer sued Heritage in the Court of Common Pleas for Clermont County Ohio, alleging violations of the above mentioned rental agreements and statutes. The suit was instituted on behalf of all persons renting residential lots from Heritage Property Group, LLC or its agents. Briefly, the complaint alleged, among other things, that defendants violated various sections of the Ohio Mobile Home Act, ORC 3733.01 et seq., and rules adopted thereunder. This matter was subsequently certified as a class action on behalf of the above described individuals.
During the course of the lawsuit, a Receiver was appointed to collect rents and apply those rents to maintenance and repairs of the mobile home park. Title to the property was subsequently transferred, and the new owner took over operations of the park. At that time the Receivership was terminated, leaving $82,940.95 in a “rent fund”. Those funds are in dispute, with plaintiffs claiming a right to those funds, as well as other parties.
The proposed settlement would be a judgment against defendant Heritage in the amount of $287,928.00, which amount includes $71,982 in attorney fees. Defendant Heritage, however, is likely insolvent and unable to pay the judgment.
During the course of the lawsuit plaintiffs’ counsel believes that certain parties and possibly persons not parties to the suit may have taken actions which give rise to a cause of action against them on behalf of plaintiffs. Therefore, Plaintiffs’ counsel may be filing additional claims.
THE PROPOSED JUDGMENT AGAINST HERITAGE
The proposed judgment would be against Heritage Property Group, LLC, and not against any of the employees or owners or the estate of the owners, who will be relieved of any responsibility for the actions of Heritage.
The proposed judgment would be just that: a judgment only. In order for you to be paid any money or receive any benefits under this judgment, your attorneys would need to collect on the judgment. In other words, your attorneys would need to find unencumbered assets of Heritage or find some other method of making the judgment viable, so that you could receive money or benefits. Therefore, at this time, there will be no benefits or money available from this judgment. The same is true for your attorneys. Unless and until some recovery is made, your attorneys will not be paid any attorney fees from this judgment.
There is no proposed settlement or judgment with any other party at this time.
HOW DO I EXCLUDE MYSELF FROM THE CLASS?
The court will exclude you from the class if you request to be excluded on or before September 20, 2013, as set out below. Any judgment, whether favorable or not, will include all class members who do not request exclusion. If you do not request exclusion you may, if you so choose, enter an appearance through your own counsel.
You can exclude yourself from the class, which means you will not be a party to any judgment, or share in any funds if recovery is subsequently had against the defendant Heritage Property Group, LLC as a result of the judgment, nor share in any funds if recovery is obtained due to the filing of additional claims. You may pursue your own claims, if any, at your own expense against defendant Heritage or other parties. To exclude yourself, on or before September 20, 2013, you must file your request to be excluded, in writing, with the Court, in care of the Clermont County Clerk of Courts, Case No. 2011 CVH 01419 270 East Main Street, Batavia, Ohio, 45103, and you must send a copy of your request to be excluded to:

WHEN AND WHERE IS THE HEARING?
A hearing will be held on the proposed judgment on September 23, 2013, at 1:00 PM at 270 East Main Street, Batavia, Ohio, 45103, in the Courtroom of the Honorable Thomas Herman, Judge, Court of Common Pleas, Second Floor, Clermont County Courthouse. You do not need to attend this hearing unless you wish to object to proposed settlement. If you do wish to opt out of the class or to object, you are strongly encouraged to attend the hearing.
WHAT HAPPENS AFTER THE HEARING?
If objections are filed, and the Court agrees with those objections, then the matter will be set for trial or the parties may propose a different judgment and/or settlement, taking into account the objections. If no objections are filed, or if all objections are overruled, the court will give final approval to the proposed judgment for the Green Acres tenants and against Heritage for the amounts set forth in this notice. At that time your attorneys will explore ways to collect on the judgment. If there is any future recovery on the judgment, or upon any other claim filed on behalf of the class, you will receive another notice, more detailed in nature, indicating how you can file a claim for part of the recovered funds. At this point the only issues are whether or not to approve the judgment against Heritage and to record all parties who wish to be excluded from the lawsuit.

Pursuant to Section 5721.03 of the Ohio Revised Code, the Auditor of Clermont County will publish a list of parcels on the delinquent land tax list beginning October 3rd, 2013. The publication of this notice will be printed for two consecutive weeks in this newspaper. Publication of the delinquent land tax list will print on October 3rd and October 10th, 2013.
Section 323.12 of the Ohio Revised Code provides for payment of taxes as follows: Each person charged with real property taxes and assessments or Public Utility property taxes on a tax duplicate in the hands of the County Treasurer may pay the full amount of such taxes on or before the thirty-first (31) day of December, or one-half (1/2) of such taxes are paid by the twentieth (20) day of June next ensuing. When such taxes are paid by installments, each payment shall be apportioned among the several funds for which taxes have been assessed.

The Stonelick Township Board of Trustees will be accepting sealed bids for a General Contractor to provide labor and materials for the construction of a new storage facility for trucks and equipment at 5750 Stonelick-Williams Corner Road, Stonelick Township, Clermont County, Ohio. All bids shall be submitted in a sealed envelope marked in the lower left hand corner of the envelope: BID-CONSTRUCTION OF NEW STORAGE FACILITY FOR TRUCKS AND EQUIPMENT FOR STONELICK TOWNSHIP. All bids must be HAND DELIVERED to the office of Stonelick Township Board of Trustees, 457 S. Broadway, Owensville, OH. 45160. No later than 2:00 p.m. local time on October 1, 2013. All bids will be publicly opened and read aloud at the Stonelick Township Board of Trustees Monthly Meeting on October 2, 2013 at 7:00 p.m.
The successful bidder shall be required to furnish a satisfactory performance bond for one hundred percent (100%) of the contract price upon execution of the contract. Said performance bond shall be made payable to the Stonelick Township Board of Trustees.

Attention of bidders is particularly called to the requirements as to safety regulations, conditions of employment to be observed and minimum wage rates to be paid under the Contract. Facsimile and electronic copies of the Bond and Power of Attorney of the Surety will be deemed non-responsive.
The Stonelick Township Board of Trustees reserves the right to waive any informalities, reject any or all bids and to hold such bids for a period of sixty (60) days before taking any action and to award a contract to the lowest and best bidder.
