The purpose of this deed is the completion of two land contracts entered into between the parties and recorded in Book 037, Page 478 and Book 784, Page 750 of the Clermont County Records.
Any person owning or claiming any right, title or interest in, or lien upon, the real property listed above should file an Answer in such action setting forth the nature and amount of interest owned or claimed and any defense or objection to the foreclosure.
An Answer must be filed in the office of the Clerk of Courts, Clermont County, Ohio within Twenty-eight (28) days after date of last publication of this notice which will be published for six consecutive weeks. The last date of publication is August 25, 2011.
If no Answer is filed or you fail to otherwise respond on or before the time stated above, a judgment of foreclosure will be taken by default as to the real property listed in the Complaint. Such real property shall be sold for the satisfaction of the taxes, assessments, penalties, interest, charges and court costs incurred in the foreclosure that are due and unpaid.
At anytime prior to the filing of the entry of Confirmation of Sale, any owner or lienholder of a parcel listed in the Complaint may redeem it be tendering to Plaintiff the amount of taxes, assessments, penalties, interest and charges due and unpaid on the parcel, together with all costs which have been incurred in the foreclosure proceeding. Each person bidding for a contract for the construction, demolition, alteration, repair, or reconstruction of any public improvement is required to file with his bid a bid guaranty in the form of either (1) a bond for the full amount of the bid or (2) a certified check, cashier’s check or irrevocable letter of credit pursuant to Chapter 1305 of the Ohio Revised Code in an amount equal to ten (10) percent of the bid pursuant to Section 153.54 of the Ohio Revised Code. The successful bidder at the time he/she enters into the contract shall be required to file a performance bond in the full amount of the contract pursuant to Section 153.54(c) of the Ohio Revised Code. In lieu of the Performance Bond, the bidder may submit a combined Bid Guaranty and Contract Bond, in conformance with Section 153.571 of the Ohio Revised Code, with the Bid Proposal. Bid security in Bond form shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety.
