Liz Carroll, convicted of murdering her 3-year-old foster child Marcus Fiesel, has been denied her appeal by the 12th District Court of Appeals.

The appeals court, which announced its decision on Dec. 28, did withdraw the jail time for the lesser charge of involuntary manslaughter, but the life sentence imposed by Clermont County judge Robert Ringland after the February jury trial will be upheld.

Carroll, who has been incarcerated in the Ohio Reformatory Women’s Prison in Marysville, Ohio, since her conviction by a jury early in 2007, will now be required to remain there for at least 54 years before she becomes eligible for parole.

The 12th District Court of a Appeals decided that the double jeopardy clauses of both the state and federal constitutions state that a person cannot be punished for both murder and voluntary manslaughter simultaneously, two charges Liz Carroll was convicted on.
